POSSESSION OF PROPERTY

Possession is certainly a crucial concept in society. In the legal world, possession is often seen as evidence of ownership, and anyone seeking to dispossess someone else must be able to provide proof of their title or some other lawful right. Possession is often deemed to be just as good as ownership when it comes to defending one’s ownership of a property. It’s worth noting that if someone can demonstrate that they’ve been in adverse possession of a property for a period of 12 years or more, they can actually become the legal owner of the property, with the original owner’s rights being extinguished.

A. Possession is actual or physical possession; it is physical relation to a thing. This simply denoted the physical capacity of a person who had the thing within his control to deal with it as he liked to the exclusion of everyone else.

B. Possession in Law; means possession in the eye of law. It means a possession that is recognized and protected by law. Law wanted to give possession, or the right to exercise a claim to the exclusive control of a thing, and along with it all the other advantages and rights which were closely associated with the idea of possession or physical control, even to a person, who had no actual physical control over it.
